General terms and conditions of sale

1 Definitions and General Conditions
These general conditions of sale (hereinafter “General Conditions”) relating to each of the products offered for sale (hereinafter “Products”) on the website www.cignoli.it (hereinafter the “Site”), govern all contracts of sale (hereinafter the “Purchases”) between the buyer (hereinafter the “Customer”) and the seller CIGNOLI ELETTROFORNITURE S.R.L. | Via IV Novembre 9 | 27045 – Casteggio – PV | Tel: +39 0383 806011 | cignoli@cignoli.it | P.IVA 00295980189 (hereinafter “Cignoli”).

Depending on the type of customer, the rules set out in Section II, distance contracts of the Legislative Decree 6 September 2005 n. 206 as amended, lastly, by Legislative Decree 21/2014 and subsequent amendments (hereinafter, for the sake of brevity, the “Consumer Code”).

The order entered by the Customer on the Site and sent through the same to Cignoli. constitutes acceptance of the General Sales Conditions.

No order can be sent without the Customer having previously and expressly indicated in the appropriate box, having read and accepted the General Conditions of sale.

2 Products and Legal Guarantee of Conformity
The following are provided for the individual Products: the name, brand, quantity, price and main characteristics in accordance with the provisions of the law.

The photographs or graphics of the Products must be considered only indicative of the presentation of the product and may not coincide with those of the Products offered. Likewise, the complementary information on the Products on the Site are purely indicative and provided for a mere commercial purpose, as communicated by the manufacturer or supplier who will remain solely responsible for the content of the same.

The offer of the Products is valid only within the limits of available stocks; Cignoli. will do its best to ensure that the Products are always available; Cignoli. will not be in any way responsible for the temporary or definitive unavailability of one or more Products. In the case of material unavailability of the Products at the time of shipment to the Customer, Cignoli. undertakes not to charge the Customer the corresponding price or to have the amount corresponding to unavailable Products re-credited as soon as possible. The Site highlights the hypotheses in which particular limitations (eg quantitative) apply to the purchase of certain types of Products.

Cignoli recognizes on all purchased Products the legal guarantee of conformity referred to in articles 128 to 135 of the Consumer Code in the event that the purchase is made by a Consumer Customer; in the event that the Purchases are made by a Professional Client, the other guarantees of the law and of the Civil Code will apply. For more information, the Customer can consult the Cignoli Customer Service, also in relation to any applicable after-sales assistance.

3 Warranty and Returns
If for some reason the Customer is not satisfied with the product he has purchased, he can exercise the right of withdrawal within 14 working days from the date of receipt of the package. You don’t need to specify why you intend to return the product. You can ask for an exchange with another item or a refund. The choice cannot be changed later.

To make use of the guarantee, a request must be made in writing by registered letter with return receipt or, more simply, by e-mail (at cignoli@cignoli.it). To speed up the response, we recommend indicating in the email subject the words: “Return request” and the order number.

The return is accepted only if the item is in the same condition in which it was received. Therefore it must be perfectly intact, it must not have been used. It must be complete with the label still attached and / or the original packaging. The guarantee applies to all products. The product must be received by us within 14 days of the return authorization date.

We recommend the use of a traceable service (therefore Registered, fast parcel 3 by Poste Italiane or express courier service) as the responsibility for delivery lies with the sender.

After Cignoli has received the returned package, and verified that all the requirements have been met, the Customer will receive the replacement item (or refund, the latter within the prescribed time). The refund will be made by reversing the payment made, if you have used Paypal. Otherwise, it will take place by bank transfer, or if preferred by Paypal payment (any fees charged to the recipient). Transport costs are NOT refundable.

In no case is it possible to reject the ordered goods at the time of delivery, this circumstance will not be considered application of the right of return, but contractual breach. Returns can only be made in the manner described above.

4 Payments
The payment methods accepted on the Site are PAYPAL and Bank Transfer. In case of bank transfer, payment must be made within 3 days of purchase, otherwise the purchase will be considered void.

5 Transport

Our shipments are made by postal service or courier. The dispatch of the goods is guaranteed within 10 working days, unless the goods are unavailable. The shipment arrives at its destination within a further 10 working days.

Delivery takes place within 20 working days from receipt of payment.

Delivery takes place on weekdays. Non-receipt of the shipment is not allowed. Placing the order involves the mandatory receipt of the shipment, without prejudice to the right of return. Any storage costs due to the absence of the recipient and errors or omissions in indicating the delivery address (including the name on the bell) will be entirely borne by the buyer.
